Can You Re-Enter Vietnam After an Overstay? (2026)
The key question is whether you received a formal deportation order or ban during your departure — or whether you simply paid a fine and left. The outcomes are very different.
Scenario 1: Short Overstay, Fine Paid, No Formal Ban
If you overstayed for fewer than 30 days and immigration processed you at the airport with a fine (no deportation order, no formal ban document), re-entry is generally possible. You would need to apply for a new valid visa — your old visa is spent.
Scenario 2: Long Overstay, Deportation or Formal Ban
If you overstayed 30+ days and were formally deported or issued a written ban under Decree 144/2021, re-entry is blocked for the duration of the ban (typically 1–5 years). Attempting re-entry during a ban period will result in denial at the border — even with a valid new visa.
What If You Have a Ban and Need to Return?
There is a formal appeal process through Vietnam’s Ministry of Public Security, but it is slow and outcomes are unpredictable. The most reliable path is to wait out the ban period. Our team can advise on your specific situation.
